All dental facilities which place or remove amalgam must have an amalgam separator and hazardous waste recycling by July 14, 2020.

If you remove or place amalgam, you must have a separator.  Some local authorities may have a different requirement, but under US EPA rule 40 CFR Part 441 you must have a separator.

At a minimum it must be in proper operating condition (i.e. no leaks).  You must have a maintenance log and follow manufacturer’s maintenance requirements. Do not rely on “What the service/sales rep says.”  All separators have an operating manual and maintenance schedule, you must follow the schedules or operating instructions provided by the manufacturer.

The new rule (40 CFR Part 441) requires that all disinfectants and vacuum line cleaners must have a pH between 6 and 8. The manufacturer must demonstrate, in writing, that the pH of the disinfectant or line cleaner will meet the pH requirements when used as instructed.  Line cleaners below a pH of 6 or above a pH of 8 will dissolve amalgam and cause high levels of mercury to be generated through dissolved mercury, potentially causing a compliance issue.

Registration with the local or state authority is required by regulation.  The owner of the dental practice is responsible for the registration.  Many local authorities have been proactive in registering the dental practice.  Many local authorities have questionnaires and inspection lists for the dental practice to fill out.  If a dental practice does not register by the October 2020 deadline, there may be penalties for not registering.
